1. What are the formalities while issuing a
No Objection Certificate (NOC)?
Now MUDA is not issuing any NOC, in respect of land coming under
C.D.P. area, instead MUDA is issuing a status report. The applicant
has to submit an application along with latest R.T.C. of the land.
Opinion from Engineering Section will be obtained to confirm that
no layout is formed in the land and the land is not required for
MUDA layout. The details of Land Acquisition will be provided to
the applicant.
2. Formalities in acquiring
the land on Mutual Consent?
With the consent of the Land Owner, Lands are purchased under section
35 of KUDA Act. The Land owners has to give his consent in writing
and it will be placed before the Authority for opinion. After obtaining
the opinion of the Authority, proposal will be submitted to the
Government for approval. After the approval from the Government
the Deputy Commissioner, Mysore, give the rates of land and then
land will be purchased and compensatory site be given as per rules.
3. Other Mode(s) of Acquisition(s)?
Lands are acquired under Land Acquisition Act of 1894. Notices under
section 4(1) and 6(1) will be issued to the Land Lords before the
acquisition of Land. After enquiry and joint measurement, value
will be fixed and under section 11 of the Act, Award will be passed.
After issuing the Award Notices and confirming the Title of the
Land, Compensation will be paid to the Land Lords or to the next
Legal heirs. If any dispute arises regarding Ownership, the Award
amount will be deposited in the District Civil Judge Court under
section 31(1) of Land Acquisition Act. Like-wise if the Owner of
the Land refuses to receive the compensation, the Award amount will
be deposited in the Court for further course of action.
