| Acquisition of Land to the
Urban Development Authority
The provisions of action 36(2) of the K.U.D.A.
Act govern the Acquisition of land for
Urban Development Authority 1987.
The Land Acquisitions Proceedings is a real problem to MUDA. It
will take more than 2 to 3 years for completion of proceedings
for various reasons. A Special Land Acquisition Officer is also
posted to MUDA to avoid the delay in acquisition proceedings.
An Assistant Commissioner with sufficient staff heads it. The
Land Acquisition proceedings are taken up under the K.U.D.A. Act
1987 under section 17, 18 and 19 of the Act and read with the
Land Acquisition Act 1894 (Central Act of 1894) and Rules there
under.
Soon after a Development Scheme has been prepared, the authority
will notify under section 17(1) of the K.U.D.A. Act 1987. This
will be called as Preliminary Notification. There after Final
Notification will be issued under section 19(1) of K.U.D.A. Act
1987. The other formalities like conducting of enquiry on objection
filed by the land holders, payment of compensation, declaration
of award etc., are followed under the provisions of the Land Acquisition
Act 1984. The provisions of the Land Acquisition Act becomes applicable
to the acquisition of land for Urban Development Authority from
section '9' onwards of the CAQ Act 1894.
Award
Section 11 and 12 of the Land Acquisition Act deals with the award.
The Land Acquisition Officer has to make an award under his hand
and make it final as per section 12 of the act. The award under
the Land Acquisition Act 1894 is in the nature of an officer to
the landlords mad by Government wishing to acquire the property.
The award is only an offer and is an Administrative Act. If the
owner accepts that is the end of the matter. The government will
approve the award. The payment of compensation will start after
the approval of the award. In MUDA payment will be made through
account section after individual award accepted by the Commissioner
and Special Land Acquisition Officer. The possession of land will
be taken up soon after the payment or a notification published
by MUDA under section 16(2) of Land Acquisition
Act 1894. The compensation amount will be deposited to
the civil court under section 31 of Land Acquisition Act in case
the Land Looser fails to produce relevant documents.
